INDEMNIFICATION AGREEMENT
The transferring of images from a photograph to another object (plaque, baseball, ornament, etc.) is considered a derivative work of the photo. As such there are copyright issues to be considered. Below are some points of the copyright law as it relates to photographs. The entire copyright law can be found at http://www.copyright.gov. 1) Buying a photo (or a set of photos) from a studio does not automatically transfer the rights for making copies or creating a derivative work. This includes wedding photographs, school photos, sport team photos, family photos, etc., taken by a professional photographer (including those taken at a retail store).
2) Photos taken prior to 1930 are considered to be in the public domain, and may be copied or used to create derivative works.
By signing the agreement below you are declaring that you either own the rights or have received permission to make a derivative work of the photograph and are authorizing u-Mean-it to reproduce the image onto another object through laser engraving. You are also declaring that u-Mean-it, its owner and its employees will not be held responsible in any way for any copyright infringement that may result from this transaction.
I, the undersigned, with intent to be legally bound, declare that the image being provided to u-Mean-it for the purposes of creating a reproduction through any method but not limited to laser engraving, knitting, imprinting, heat transfering, etc does not infringe upon any copyright, trademark or other intellectual property rights (including trade secrets), or other rights of any person or entity. If I become aware of any such possible infringement, I shall immediately so notify u-Mean-it in writing. I agree to indemnify and hold u-Mean-it harmless from and against all liabilities, demands, damages, expenses, or losses arising out of (i) use by the undersigned or my transferees of reproductions produced by u-Mean-it (ii) sale, or other disposition by the undersigned or my transferees of products made by use of such images or reproductions. This indemnification shall include attorney fees and expenses.
